Terms of Service

By accessing or using the Kiteum platform, website, and associated services (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the Services. Kiteum reserves the right to update these terms at any time.

Kiteum provides a cloud platform for developers to deploy, host, and manage web applications, databases, and autonomous AI agents. The Services include build pipelines (via Git or ZIP upload), edge routing, container orchestration, and telemetry. We reserve the right to modify, suspend, or discontinue any part of the Services at any time.

You must provide accurate information when creating an account. You are strictly responsible for maintaining the security of your account, credentials, and any environment variables or API keys stored on our platform. Kiteum is not liable for any loss or damage arising from unauthorized access to your account resulting from your failure to secure your credentials.

You agree not to use the Services for any unlawful or abusive activities. Specifically prohibited activities include, but are not limited to:

• Hosting or distributing malicious software, malware, or phishing campaigns.
• Cryptocurrency mining or utilizing compute resources for blockchain proof-of-work.
• Deploying AI agents designed to spam, scrape illegally, or execute Denial of Service (DoS) attacks.
• Violating the intellectual property rights of others.

Violation of this policy may result in immediate account termination without refund.

Certain features, such as our AI Agent orchestration, may be labeled as "Beta" or "Early Access." These features are provided "as-is" and may contain bugs, errors, or experience downtime. Kiteum does not guarantee the continuous uptime of Beta services and is not liable for data loss or execution failures originating from them.

Paid plans are billed in advance on a recurring monthly or annual basis. Your plan includes specific hard limits on compute, memory, and bandwidth. While we do not automatically charge overage fees without your consent, exceeding your plan limits may result in throttled performance or temporary suspension until you upgrade your tier. All fees are non-refundable except as required by law.

You retain all rights and ownership to the code, data, and content you deploy to Kiteum. By uploading your project, you grant Kiteum a limited, worldwide, royalty-free license to host, run, and display your code strictly for the purpose of providing the Services to you. Kiteum claims no ownership over your intellectual property.

In no event shall Kiteum, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or inability to access or use the Services.

You may terminate your account at any time via the Kiteum dashboard. Kiteum may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms of Service. Upon termination, your right to use the Services will immediately cease.
